Terms of Service

These terms govern your GreenMind account and your use of the websites, games and services operated by GreenMind Media Inc. ("GreenMind", "we", "us" or "our"). By creating an account or using any of our services, you agree to them. If you do not agree, do not use our services.
Individual products have their own terms in addition to these. Where a product's terms address something specific to that product, they govern for that product; these terms govern everything else, including your account itself.
1. One account, many services
Your GreenMind account is a single account. It signs you in to every GreenMind service that offers sign-in, whether through Google or an email address, and what you do in one service is done under the same account as every other.
That cuts both ways: a suspension or termination of your account for breaching these terms applies across all of our services, not only the one where the breach occurred.
2. Your account
You must be old enough to form a binding contract where you live, and at least 13 years old in any case. A product may set a higher minimum age in its own terms.
You are responsible for everything done through your account, for keeping your sign-in credentials secure, and for the accuracy of the information you give us. Tell us promptly if you believe your account has been accessed without your permission. One person, one account; do not share an account or use another person's.
3. Acceptable use
You must not use our services to create, store, transmit or do anything that:
- is unlawful in any jurisdiction in which it is stored or accessed;
- sexualises minors in any way, whether real or fictional, or constitutes child sexual abuse material;
- depicts, promotes, incites or glorifies terrorism, genocide, mass violence, or violence against any person or group;
- harasses, threatens, defames, or invades the privacy of a real, identifiable person;
- promotes hatred against, or dehumanises, people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation;
- infringes anyone else's copyright, trademark, or other intellectual-property rights;
- contains malware, or is used to gain unauthorised access to our services, other accounts, or any connected system;
- cheats, exploits bugs, or otherwise interferes with other people's use of a game or service, or with the service itself;
- impersonates GreenMind, our staff, or any other person.
You must not use automated means to place unreasonable load on our services, resell access to them, or attempt to circumvent access controls, rate limits or usage restrictions. Our games and fiction go to dark places; this section is about material and conduct that is unlawful or causes real-world harm, not about difficult subject matter in a story.
4. Content you provide
You keep ownership of the content you create or upload. We claim no ownership of it.
You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit and display your content, but only so far as is necessary to operate the service for you and for the people the service is designed to show it to, such as other players or people you have granted access. This licence exists so that we can run the software; it is not a licence to publish, sell, license or otherwise exploit your work. A product's own terms may describe more precisely how content is shared within that product.
You are responsible for keeping your own copies of anything you would not want to lose.
5. Moderation, suspension and termination
We may review, moderate, restrict, remove or refuse to store any content, and may suspend or terminate any account, at our sole discretion, including where we believe these terms or a product's terms have been broken, where we are required to act by law, or where we consider the content or conduct harmful to a service or to others.
We may act without prior notice where we judge it necessary. We will try to tell you why when we reasonably can, but we are not obliged to. We are not obliged to monitor content, and choosing not to act in one case does not waive our right to act in another. If your account is terminated for breach, we may delete your content without providing a copy of it.
You may stop using our services and close your account at any time by contacting us at the address below.
6. Our property
Our services, games, software, names, logos, artwork and other material are owned by GreenMind or its licensors and are protected by copyright, trademark and other laws. You may use them as the services are designed to be used and not otherwise. You must not copy, modify, distribute, sell or lease any part of them, reverse-engineer or attempt to extract their source code except where the law expressly permits it, or use our names or logos without our written permission.
7. Purchases and virtual items
Where a service offers paid plans, items or currency, the product's own terms and the terms of the store you buy through (such as Steam, Google Play or the App Store) govern the purchase. Virtual items and currency are a limited, revocable licence to use them within the service; they have no monetary value, are not your property, and cannot be exchanged for money. Refunds are handled according to the store's policy, except where the law requires otherwise.
8. Third-party services
Our services work with services we do not operate, such as Google sign-in, Steam, Epic Online Services, Discord and the app stores. Their terms and privacy practices apply to your use of them. We are not responsible for third-party services, and their availability may affect ours.
9. Privacy
How we collect and use personal information is described in our Privacy Policy, which forms part of these terms.
10. Availability and changes to our services
We do not guarantee that any service will be available, uninterrupted, or free of errors. We may modify, suspend or discontinue any service or any part of one at any time, with or without notice, and we are not obliged to keep any service running or to preserve any data.
11. No warranty
Our services are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that a service will meet your requirements, that it will be secure or uninterrupted, or that any data will be preserved or recoverable.
12. Limitation of liability
To the fullest extent permitted by law, GreenMind Media Inc., its officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of profits, revenue, data, goodwill, or content, however caused and on any theory of liability, arising out of or relating to your use of or inability to use our services.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to our services will not exceed the greater of the total amount you have paid us in the twelve months preceding the claim, or fifty Canadian dollars (CA$50).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is so, the exclusions and limitations above apply to the fullest extent permitted, and nothing in these terms limits liability that cannot lawfully be limited.
13. Changes to these terms
We may change these terms at any time, for any reason, and in any respect, at our sole discretion. Changes take effect when the revised terms are posted at this address, and the date above is updated to reflect it.
Where a change is material we will make reasonable efforts to bring it to your attention, but we are not obliged to give advance notice, and it is your responsibility to review these terms from time to time. Continuing to use our services after a change takes effect means you accept the revised terms. If you do not accept them, stop using our services and close your account.
14. Governing law
These terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. The courts of Saskatchewan have exclusive jurisdiction, and you consent to their jurisdiction and venue.
15. General
If any provision of these terms is found unenforceable, it will be limited or severed to the minimum extent necessary and the remainder will stay in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy and the terms of any product you use, are the entire agreement between us about our services. You may not assign them; we may, in connection with a merger, acquisition or sale of assets. Sections 4 (as to the licence necessary to have operated the service), 6, 11, 12, 14 and 15 survive the closure of your account.
